The police received a tip that a man on the beach block was exposing himself. When the police arrived, they saw the man that fit the description provided by the caller but did not see any illegal conduct. The police ordered the man/defendant to come over and speak with them. The police allege that as he approached their vehicles he tried to discard methamphetamine.
Outcome: Mr. Sobel filed a Motion to Suppress and was able to show that the actions by the police in ordering the defendant to come and speak with them were illegal and not supported by reasonable suspicion. The court granted the Motion to Suppress and the state subsequently dismissed the charges.
