Facts: A Hollywood Police Officer observed a white vehicle traveling at a high rate of speed.  The officer activated his radar and confirmed that the vehicle was driving in excess of the posted speed limit and conducted a traffic stop.  The officer alleged that the driver had an odor of an alcoholic beverage emaniating from his person.  Based upon this observation, the officer conducted a DUI investigation and ultimately arrested the defendant.

Outcome:  Mr. Sobel conducted his own investigation including setting both officers involved in the case for deposition.  Mr. Sobel filed a motion to suppress arguing that the officer did not have the necessary reasonable suspicion of DUI to conduct the DUI investigation.  The court granted the motion and suppressed all evidence gathered from the DUI investigation.  The Office of the State Attorney dismissed the charges.
