Felony Possession of Cannabis-Dismissed

Facts:  The defendant was sitting in the passenger seat of a car driver by her boyfriend.  A man walked up to the car and took out a zip top bag of Marijuana.  The man handed the marijuana to the defendant who then passed it to the driver.  The driver then put the marijuana in a backpack in the backseat.  The driver then handed the defendant money that was then given to the man outside the car.

A undercover police officer was parked in his car a few spots down and saw the entire incident.  The defendant was eventually arrested and charged with Felony Possession of Cannabis and Possession of Drug Paraphernalia that was found in her purse.

Outcome:  Mr. Sobel took a deposition to secure the facts and filed a Motion to Dismiss.  Prior to the hearing on the Motion to Dismiss, the Office of the State Attorney conceded to the motion and dismissed the case outright.
