Facts: It was alleged that the defendant was stopped by law enforcement in relation to a narcotics investigation. After determining that the defendant was not in possession of any narcotics, the defendant was issued a criminal traffic citation for driving without a valid driver’s license. The report submitted by the narcotics detective contained no details at all about the incident. Mr. Sobel filed a motion to compel further discovery and took a deposition of the arresting detective.

Outcome: Mr. Sobel filed a Motion to Suppress the stop. The court granted the motion to suppress finding that the detention was illegal as it was not supported by either reasonable suspicion or probable cause.
