RESISTING ARREST WITH AND WITHOUT VIOLENCE–DISMISSED

Facts:  The defendant was arrested after he physically tried to stop the police from arresting his brother.  The defendant was arrested and charged with the felony Resisting an Officer With Violence.  Mr. Sobel was immediately hired on the case and was able to get the case filer to file a misdemeanor charge instead of the felony.   Once the misdemeanor charge was filed, Mr. Sobel took the depositions of the arresting officers and then used those depositions to file a 70 page sworn motion to dismiss outlining numerous areas of police misconduct.

 

Outcome:  On the day that the motion to dismiss was supposed to be heard in court, the Office of the State Attorney dismissed the case outright.
