WHEN SHOULD I HAVE MY RECORD SEALED OR EXPUNGED?

IMMEDIATELY!!  If you are eligible to have your record sealed or expunged then you should do it immediately. I cannot tell you how many times I have had people call my office looking to get their record sealed or expunged because they are going to have a background check for a new job. I get the same reaction from everybody when I tell them that the process takes between 4-6 months and that there is no way to speed up the process. Most people think that they can get their record cleared off immediately and don’t realize the detailed and length process in sealing/expunging your record.

The first and most important question in sealing/expunging a record is, “Are you eligible?” This determination is fairly simple.

1. What was the disposition of the case that you are seeking to have sealed/expunged?

2. Have you ever had a prior record sealed/expunged?

3. Have you ever been adjudicated guilty of a crime?

IF you can answer these three simple questions then you will be able to determine if you can have your record sealed or expunged.
